These Terms of Service ("Terms") govern access to and use of the Fischer Mill Supply, Inc. online store, website, content, products, and related services.

Throughout these Terms, "Fischer Mill Supply," "we," "us," and "our" refer to Fischer Mill Supply, Inc.

By accessing our website, placing an order, or otherwise using our online services, you agree to these Terms.

1. Eligibility

Our Shopify store is intended primarily for the sale of parts, apparel, supplies, and related merchandise.

Tractors, implements, mowers, and other equipment displayed elsewhere by Fischer Mill Supply may be subject to separate sales terms and are not necessarily available for purchase through the Shopify store.

4. Pricing and Inventory Errors

Fischer Mill Supply, Inc. reserves the right to cancel, refuse, or refund an order, including after it has been submitted, when reasonably necessary because of:

Incorrect specifications
Inventory discrepancies
Suspected fraud
Payment problems
Manufacturer discontinuation
Product unavailability
Inability to obtain merchandise
Other material errors affecting the transaction

If payment has already been collected for a canceled item, the applicable amount will be refunded.

5. Inventory Availability

A product appearing as "in stock" or available online does not guarantee availability.

Inventory can be sold in-store, online, allocated to another customer, damaged, miscounted, discontinued, or otherwise unavailable before an online order is processed.

An order is not guaranteed to be fulfilled merely because the website accepted the order.

6. Online and In-Store Pricing

Online pricing may differ from pricing available at our physical location.

Unless expressly stated otherwise, advertised prices do not include shipping, freight, applicable taxes, installation, assembly, dealer preparation, labor, or other services or charges.

7. Parts Compatibility and Fitment

The customer is responsible for determining that a product is appropriate for the intended machine or application before ordering or installing it.

Equipment parts frequently vary according to serial number, production date, equipment configuration, and other specifications.

Website fitment information is provided as a convenience and should not be treated as a substitute for verification.

8. Installation and Use

Parts and products should be installed, operated, maintained, and serviced in accordance with applicable manufacturer instructions, safety information, service manuals, and industry practices.

Certain repairs or installations should only be performed by qualified personnel.

Website content is not a substitute for a manufacturer's operator manual, service manual, safety bulletin, recall notice, professional diagnosis, or other authoritative technical information.

9. Orders

We reserve the right to accept or refuse any order to the extent permitted by law.

We may limit quantities or cancel orders that appear fraudulent, abusive, commercially unreasonable, intended for unauthorized resale, or inconsistent with these Terms.

10. Cancellations

Regular orders may be canceled before shipment by calling 503-631-3411, subject to confirmation by Fischer Mill Supply.

Orders that have already shipped are subject to our Return & Refund Policy.

Special-order products are non-cancelable and non-refundable immediately after the order is placed.

11. Returns

All returns and exchanges are governed by our Return & Refund Policy, which is incorporated into these Terms.

12. Shipping

All shipping is governed by our Shipping Policy, which is incorporated into these Terms.

13. Manufacturer Warranties

Many products we sell are manufactured by third parties and may be covered by a manufacturer's limited warranty.

Unless Fischer Mill Supply expressly provides a separate written warranty, Fischer Mill Supply does not create or extend an additional voluntary product warranty beyond applicable manufacturer warranties and rights provided by law.

Manufacturer warranty terms, exclusions, claim procedures, and remedies control the manufacturer's warranty.

Proof of purchase may be required.

Nothing in these Terms excludes, restricts, or modifies warranties, consumer protections, or other rights that applicable law does not permit us to exclude, restrict, or modify.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Fischer Mill Supply, Inc. will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use, inability to use, purchase, installation, failure, or improper application of products purchased through our online store.

This includes, where permitted by law, claims for:

Equipment downtime
Substitute equipment
Labor
Diagnostics
Travel
Towing
Removal
Reinstallation

Nothing in these Terms limits liability that cannot legally be limited or excluded.

Our website and its content are provided for general informational and commercial purposes.

To the fullest extent permitted by law, the website itself is provided on an "as available" basis without guarantees that access will always be uninterrupted, secure, current, or error-free.

Product warranty rights are addressed separately above and are not eliminated by this website disclaimer.

You may not use our website to:

Commit fraud or impersonate another person.
Submit false payment or account information.
Attempt unauthorized access to systems or accounts.

Third-party trademarks and logos remain the property of their respective owners and are used for identification, product marketing, compatibility information, or in connection with applicable authorized dealer or distributor relationships.

No ownership of a third-party trademark is claimed by Fischer Mill Supply, Inc.

Fischer Mill Supply, Inc. is not responsible for third-party websites or services except to the extent required by applicable law.

21. Governing Law and Disputes

These Terms and transactions with Fischer Mill Supply, Inc. are governed by the laws of the State of Oregon, without regard to conflict-of-law principles, except where applicable federal law or another jurisdiction's non-waivable consumer protection law provides otherwise.

To the extent permitted by law, disputes arising from these Terms or online transactions with Fischer Mill Supply, Inc. shall be brought in an appropriate Oregon state court located in Clackamas County, Oregon, or, when federal jurisdiction applies, in the United States District Court for the District of Oregon.

22. Severability

If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.
